2. Our services

LevelCore operates a national capital platform that connects qualifying businesses with commercial financing options through our network of lending and capital partners.

3. Eligibility

Our services are intended for for-profit business entities operating in the United States. We reserve the right to refuse service, decline applications, or terminate access at our sole discretion, consistent with applicable law.

4. Accuracy of information

You agree to provide true, accurate, and complete information when using our services. Providing false or misleading information may result in denial of your application or termination of access, and may constitute fraud.

5. Communications consent

By providing your contact information, you consent to receive communications from LevelCore and our capital partners, including phone calls (which may include calls using automated dialing systems or pre-recorded messages) and text messages. Consent is not a condition of applying. Message and data rates may apply. You may opt out of SMS by replying STOP to any text from us, and you may unsubscribe from marketing emails at any time.

6. Intellectual property

All content on our website, including text, graphics, logos, images, designs, and the LevelCore name and branding, is the property of TrustTech LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any content on our website without our prior written permission.

7. User conduct

You agree not to use our services in any manner that violates applicable law, infringes any rights of others, interferes with or disrupts our services, attempts to gain unauthorized access to our systems, or involves submitting false or misleading information. We do not guarantee that any application will be approved, that financing will be available on any particular terms, or that timing estimates will be met. Any information on our website, including examples of rates, terms, and amounts, is for illustrative purposes only and does not constitute an offer of credit.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LEVELCORE, TRUSTTECH LLC, OR ANY OF OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless TrustTech LLC, LevelCore, and our affiliates, officers, directors, employees, agents, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to your use of our services, your violation of these Terms, your violation of any rights of another party, or any false or misleading information you provide.

11. Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be resolved through binding individual arbitration, not in court, except as specified below. Arbitration shall be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Charleston, South Carolina, or may be conducted remotely.

Class action waiver. You and LevelCore agree to bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

Exceptions. Either party may (a) bring a small-claims-court action within that court's jurisdiction, or (b) seek injunctive or equitable relief to protect intellectual property or confidential information.

Opt-out. You may opt out of this arbitration provision by sending written notice to us at the contact address below within thirty (30) days of first agreeing to these Terms.

12. Governing law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law provisions. Subject to the arbitration provisions above, any disputes shall be resolved exclusively in the state or federal courts located in Charleston County, South Carolina.

13. Termination

We may suspend or terminate your access to our services at any time, with or without notice, for any reason. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and arbitration, will survive.

14. Changes

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. Your continued use of our services after changes take effect constitutes acceptance of the updated Terms.
